Terms of Service

Last updated: January 3, 2026
These Terms of Service (“Terms”) govern your use of [Polly] (the “App”). By downloading, accessing, or using the App, you agree to these Terms.

1) The App

[Polly] is a language-learning app that provides study and quiz experiences. The App is for informational/educational purposes only.

2) Eligibility (13+)

You must be at least 13 years old to use the App. By using the App, you confirm you meet this requirement.

3) No professional advice

The App is not a substitute for professional education, certification programs, or official instruction. We do not guarantee results, fluency, or accuracy in every context.

4) Subscriptions, billing, and refunds

Subscriptions

Some features may require a paid subscription. Subscription details (price, duration, trial) will be shown in the App before purchase.

Billing

Purchases are processed through the Apple App Store (and/or Google Play, if applicable). We do not handle or store your payment method details.

Refunds (Apple policy)

Refunds are handled according to Apple’s refund policy (and/or the applicable store’s policy). You may need to request a refund directly from Apple. We cannot guarantee refunds and do not control Apple’s decision.

5) RevenueCat

We use RevenueCat to manage subscription status and entitlements (e.g., determining whether premium features are unlocked). Your subscription access may depend on successful validation through the store and RevenueCat.

6) Acceptable use

You agree not to:

  • misuse the App, attempt to hack it, or interfere with its normal operation

  • reverse engineer or attempt to extract source code except where permitted by law

  • use the App to violate any law or regulation

  • use the App in a way that infringes intellectual property rights

7) Intellectual property

The App, including its design, text, graphics, exercises, and content (excluding content owned by third parties), is owned by us and protected by applicable laws.

You receive a personal, limited, non-exclusive, non-transferable license to use the App for your own non-commercial use, subject to these Terms.

8) Availability and changes

We may:

  • modify, update, or discontinue features

  • add or remove languages, lessons, or quizzes

  • limit availability in certain regions

We do not guarantee that the App will always be available or error-free.

9) Disclaimers

To the maximum extent permitted by law:

  • The App is provided “as is” and “as available”.

  • We make no warranties (express or implied) about accuracy, fitness for a particular purpose, or uninterrupted operation.

10) Limitation of liability

To the maximum extent permitted by law, we are not liable for:

  • indirect, incidental, special, consequential, or punitive damages

  • loss of profits, loss of data, or business interruption

  • issues caused by your device, OS, network, or app store services

Nothing in these Terms limits liability where it cannot be limited under German law (for example, liability for intent or gross negligence, or mandatory consumer protections).

11) Indemnity

If you violate these Terms or misuse the App and it causes claims or damages, you agree to indemnify and hold us harmless to the extent permitted by law.

12) Termination

You may stop using the App at any time. We may suspend or terminate access if you violate these Terms or if necessary for security/legal reasons.

Subscriptions must be cancelled through the App Store (and/or Google Play), not by deleting the App.

13) Sanctions / restricted territories

The App may not be available in certain countries or regions due to legal requirements, including U.S. or international sanctions or export controls. We may restrict access where required.

14) Governing law

These Terms are governed by the laws of Germany, excluding conflict-of-law rules.

If you are a consumer in the EU/EEA, you may also have mandatory rights under the consumer laws of your country of residence that are not limited by these Terms.

15) Dispute resolution (Arbitration preference + consumer carve-out)

We prefer to resolve disputes informally first. Please contact [hello.PollyApp@gmail.com] and we’ll try to solve the issue quickly.

For business users (B2B): To the extent permitted by law, disputes may be finally settled by arbitration in Germany under an appropriate arbitration framework, with the seat of arbitration in Germany.

For consumers (B2C): If mandatory consumer protection law gives you the right to bring claims in court, nothing in these Terms removes that right. If arbitration is not enforceable in your case, disputes will be handled by the competent courts.
